Terms

The agreements, in plain sentences.

Who you're agreeing with

Up by Friday provides this service. You can reach us at hallo@upbyfriday.com, which is also the address for everything below. The agreement starts the moment you create a business.

What you get

A website for your business, the screens to keep it up to date, and the features in your plan. We do our best to keep everything working, and when something breaks we fix it.

What it costs

The amount on the pricing page, per month, in advance. If we change the price you'll hear at least a month beforehand and you may cancel.

Cancelling

Monthly, without notice and without a reason. You take your menu and photos in a usable file. Your domain name is and stays yours.

What stays yours

Everything you make: your texts, your photos, your menu, your domain name and your guests' details. We only have the right to show it on your site.

What we don't guarantee

We promise no Google rankings and no number of orders. During an outage we do our best, but we don't compensate lost revenue.

Your account

You sign in with a code by email, so there is no password to lose. Make sure you can reach that mailbox: whoever can, can reach your site. If you share your account with someone in your business, you remain responsible for what happens there.

What you put on your site

Your text and your photos are yours, and you warrant that you may use them. What isn't allowed: anything against the law, someone else's work without the right to it, or an offer that doesn't exist. If we see something like that we email you first and ask you to take it down.

Paying

Monthly, in advance, automatically. If a payment fails we try again and let you know. If it keeps failing we pause your site after two weeks rather than deleting it: it goes offline, your data stays, and one payment brings it back.

When we can stop

Almost never, and only for a reason you hear from us. Misuse of the service, content that stays up after we ask, or months without payment. Before it comes to that you get an email and a chance to fix it.

Availability and maintenance

We want your site up always, and we don't always manage it. Maintenance happens outside busy hours, and during an outage you can read on our side what's going on instead of guessing. We don't give a guarantee in percentages, because you couldn't verify it.

What we're liable for

For damage we demonstrably cause, up to what you paid us in the twelve months before. Not for lost revenue, missed orders or what follows from those. That isn't an incantation: it's the reason the price is what it is.

If these terms change

You hear about it at least a month in advance, by email, with what's changing. If you disagree, you may cancel before it takes effect.

Which law applies

Dutch law. If we can't work it out together, the courts in the Netherlands have jurisdiction. But call or email first: almost everything is solved in one conversation.
